Impeachment plot against Jonathan uncovered

MAJOR opposition parties in the country are said to be hatching an impeachment plot against President Goodluck Jonathan if the Peoples Democratic Party (PDP) insists on removing the Speaker of the House of Representatives, Honourable Aminu Tambuwal, from office over the zoning controversy.

Sources at a meeting of leaders of the Congress for Progressive Change (CPC) in Abuja that was held on June 14, told the Nigerian Tribune that the opposition parties had resolved to back Tambuwal as Speaker, notwithstanding the thinking within the PDP.

The meeting, which was attended by seven top members of the party, was said to have been briefed by a close ally of the party’s presidential candidate, Major-General Muhammadu Buhari (retd), who stated that the leadership of the CPC, the Action Congress of Nigeria (ACN) and the All Nigeria People’s Party (ANPP) had agreed to defend Tambuwal and use opposition to him as a launch pad of an impeachment plot against the president.

The CPC leaders said at the June 14 meeting that they had directed members of the party in the National Assembly to team up with other opposition parties to seek the impeachment of President Jonathan if the PDP insists on removing Tambuwal.

A source close to the meeting said: “The CPC resolved that should the PDP and the Presidency insist on removing Tambuwal from Office as Speaker using the instrumentality of the Economic and Financial Crimes Commission (EFCC), opposition political parties, including the Action Congress of Nigeria, (ACN), the All Nigeria Peoples Party (ANPP) and the CPC, have all agreed that their elected National Assembly members should threaten to impeach Mr President, in order to keep him off-balance. It is when there is stability, that his mind would be on removing Tambuwal.”

One of the leaders of the CPC also told the meeting that some groups and individuals had promised to provide “hard, irrefutable evidences of impeachment,” to be used against President Jonathan and that such evidence could actually lead to his eventual impeachment.

Arik aircraft in near mishap

WHAT would have been a tragic air disaster was averted, Monday, when an Arik aircraft scheduled to fly Enugu to Abuja by 8.50am almost crashed four minutes after take-off from Akanu Ibiam Airport, Enugu.

The over 100 passengers on board would have perished if the pilot had not turned round and made an emergency landing.

Captain of the Boeing 737-800 aircraft with registration number F-MJK, whose name could not be ascertained, was quoted to have said he turned back to the airport when he noticed that the right engine had failed.

Meanwhile, speaking to aviation correspondents in Lagos on the incident, Dr. Harold Demuren, Director-General of Nigerian Civil Aviation Authority, NCAA, said the air return was necessitated by the indicator in the cockpit, adding that it was the best option the pilot took to avoid a fatal accident.

He said: “The pilot took a precautionary measure to ensure safety of the passengers.”

Spokesman of Arik Air, Mr. Ola Banji, said: “What happened was that the captain noticed an indication light on and had to make an air return as a precautionary measure.

“At no time was the lives of the passengers put in danger.”

However, NCAA has already grounded the aircraft until it is certified to fly again.

Customary court president kidnapped in Delta

A female Customary Court President was, on Sunday, kidnapped by five gunmen. The woman, identified as Ufuoma Lordson Egebule was abducted at Ohwrode –Orhuwhorun road in Udu Local Government Area of the state.

Nigerian Tribune gathered that the incident occurred at about 2:00p.m. while the victim was on her way to Warri from Ughelli in company of her two children and a sister-in-law.

The widow, who was driving her Peugeot 504 official car marked DTSJ was overtaken and blocked by the kidnappers.

Security sources disclosed that the kidnappers singled her out of the car, took her car key and drove her away to an unknown destination, leaving the children and sister-in-law stranded.

The kidnappers were said to have operated in an ox-blood Jetta car with one of them resembling a half cast.

The abductors were yet to contact the relations of their victim as of the time this report was being filed.

Delta State Police Public Relations Officer, ASP Charles Muka, could not be reached on his mobile phone for comments on the matter.

Indian company to boost rice production in Nigeria

AN Indian-owned company, Popular Farms and Mills, has expressed its determination to support rice production in Nigeria, to make the country independent in rice production in the next five years.

The Managing Director of the company, Dr A. Balamurugan, made the disclosure while speaking at an interactive session organised by the company for rice farmers in Hadejia, Jigawa State, adding that his company had secured licence to engage in agricultural activities in Nigeria.

Mr Balamurugan said in a plan to complement the effort of the government in the development of rice production in the country, the company would offer technical support, as well as train farmers in modern rice production.

He, however, noted that the company would also help farmers in Nigeria to access qualitative seeds, fertiliser, chemicals and other modern farms implements that would make their farming more profitable.

Balamurugan said before the end of the year, the company would inaugurate a rice milling plant, with a capacity of processing 350 bags per hour in Kano State.

According to him, the plant, when inaugurated, would provide a good market for rice farmers in Nigeria, as rice to be processed in the company would be sourced from local farmers.

He said to achieve the goals, the company had commenced trainings for rice farmers in Kano, Katsina, Kaduna and Jigawa states, adding that “as we are about to inaugurate our rice plant, we will keep up and continue expanding our activities aiming at making Nigeria self reliant in rice production in the next five years.”

Balamarugan solicited the support of governments at all levels to make policies and programmes that would provide conducive atmosphere for the development of rice production in the country.

Ex-envoy to Nigeria faces raps over $95,000 fund

MANILA, Philippines—A former ambassador is being haled to court over allegations that he misused more than $95,000 (roughly P4.1 million today) in funds meant for the safe release and repatriation of Filipino seamen abducted in Nigeria several years ago.

Acting Ombudsman Orlando Casimiro has ordered the filing of malversation charges against former Ambassador to Nigeria Masaranga Umpa for allegedly paying for nonexistent transactions related to the repatriation of Filipino overseas workers (OFWs).

The Office of the Ombudsman based its charges on a complaint filed by the Department of Foreign Affairs (DFA).

According to the Office of the Ombudsman, the DFA accused Umpa of using fabricated documents to support questionable transactions amounting to $95,856.

The DFA had sent Umpa $174,000 in 2007 to be used for the safe release and repatriation of 24 seamen and crew members of the Baco Liner II and one other OFW.

The DFA said that in one transaction, it was made to appear that Wellington Hotel Ltd. in Warri Delta State, Nigeria, was paid for the cost of six hotel rooms and meals for 11 police escorts.

But the transaction was found to be supported by fake documents. The hotel’s accountant, Adeleke Osinuga, told the DFA the documents presented to him for certification did not come from the hotel.

The hotel bills showed that breakfast and lunch charges amounted to $1,565, an amount the DFA found unbelievable.

It was further noted that the bills were not stamped “paid” and the charges were billed on the alleged date of departure. The cash vouchers were also not signed by the regular administrative officer. The hiring of 11 escorts was also excessive since only six were allowed.

Another questionable transaction was the supposed booking of a room at Hotel Presidential in February 2007 for police escorts. It was discovered that the escorts stayed at another hotel. Expenses amounting to $20,994 were supported by bogus documents, it was alleged.

Another supposed stay in March 2007 at the Hotel Presidential was also found to have never taken place, and the supporting documents were allegedly fabricated.

Umpa also allegedly presented documents to show that a helicopter and van were chartered to ferry OFWs. Again, the DFA found that no such vehicles were used.

Court orders inventory of MKO’s assets

A Lagos High Court has appointed a judiciary valuation officer with the administrators of the late politician, Chief MKO Abiola, to take inventory of his assets across the country and abroad.

Justice Joseph Oyewole, in an enrolment of order ordered that “everybody who has information regarding any and every asset belonging to the late Chief Bashorun Moshood Kashimawo Olawale Abiola is hereby compelled to release all such information relating to such assets to the applicant, (an Administrator of the Estate).”

The order of the court is expected to give effect to the last Testament of the late Abiola, dated October 25, 1998, where he willed money in his accounts in the United Kingdom to some of his immediate and extended family members and some other beneficiaries.

Justice Oyewole also ordered that the approval on his Will granted by a High Court of Justice of England and Wales, the District Probate Registry at Winchester on July 22, 2010, be 'resealed', to enable the Administrator of the Will to act on it in Nigeria.

Since the order made on the Will was granted outside Nigeria by the High Court of Justice of England and Wales, the District Probate Registry at Winchester, while some of the assets are situated within the country, the applicant, Boma Ozobia, a lawyer, said “it is necessary to have the English Grant, resealed in this state, (Lagos) in order to enable Administrators to deal with those assets.”

This, according to the applicant, will enable them to take proper stock/ inventory of all the assets of Abiola situated in Nigeria as required by law in order to administer them in line with his (Abiola’s) Will.

The order of the court was as a result of a motion filed by Ozobia, on behalf of the Administrators of the the Estate of Chief Abiola, asking the court, among others, to determine

“whether the applicant, (Administrator) is entitled to take inventory of the assets of the deceased and administer them in accordance with the duly proven Will of the late business mogul and “administer them in accordance with the duly proven Will of the deceased by the provision of Order 55 rule 11 of the High Court of Lagos State (Civil Procedure) Rules.”

She also asked the court to determine whether by the provision of the Order 55 rule 3 of the High Court of Lagos State (Civil Procedure) Rule, only the named executors or administrators or an officer of the court are permitted to administer or otherwise deal with the property and other assets of the deceased in accordance with the Will and whether all person in possession or in custody of such assets belonging to the deceased had a duty or obligation to render account of such assets to the administrator.

The trial judge ordered the “resealing of the grant and giving effect to the orders of the High Court of Justice of England and Wales, the District Probate Registry at Winchester, dated October 6, 2004 and the High Court of Justice Chancery Division in London, made by Master Moncaster, dated July 22, 2010, giving validity to the said Will of the deceased dated October 25, 1980 and appoint the persons named therein as administrator, until such time as the said administrators are able to conclude the task of identifying and gathering in all assets of the deceased.”
In an affidavit in support of the summons filed by Ozobia, she said an order, dated October 6, 2004, by the High Court of England and Wales in the District Probate Registry at

Winchester gave force and validity to the last Will made by Abiola, dated October 25, 1998, appointing one Timothy Hugh Daniel of 43, Fetter Lane, London and Kolawole Abiola, son of the deceased, as administrators of the estate.

Ozobia, a lawyer, averred that another order of the High Court of Justice, Chancery Division in London, dated July 22, 2010, appointed her as administrator of the estate of the deceased in place of Adam Broke.

Oyo police place N1m ransom on Tokyo, Auxiliary

The Oyo State Police Command has placed N500,000 as ransom for each on the wanted leaders of the proscribed National Union of Road Transport Workers (NURTW) in Oyo State, Alhaji Abdul Lateef Akinsola popularly known as Tokyo and Mr Lamidi Mukaila as known as Auxiliary

The state Commissioner of Police, Baba Adisa Bolanta, told the Nigerian Tribune in Ibadan on Sunday that the command would give N500,000 to anybody who could provide information that would lead to the arrest of the union leaders.

He also disclosed that the command had pasted photographs of the union leaders in strategic places in the state capital to ensure their arrest.

The photographs of Tokyo and Auxiliary were seen pasted around Dugbe, Mokola and Eleyele areas of the state capital.

The police boss had, while addressing newsmen in Ibadan last week, promised to ensure that the union leaders were arrested.

He said that the union leaders had been declared wanted for their alleged roles in the recent mayhem in Ibadan during which about 20 people were killed and many others were injured while property worth millions of naira were destroyed.

He declared that the command would do everything possible to ensure that the two people were brought to justice.

According to him, apart from ensuring the confidentiality of anybody that brings information that can lead to their arrest, he/she would also be paid the money promised.

4 ex-corps members, 24 others die in Enugu–Nsukka road accident

About 28 persons including four corps members discharged last week are feared dead in a ghastly motor accident along Enugu - Nsukka road.

The accident, which occurred at Amoka in Udi Local Government area of Enugu State, involved two commercial vehicles belonging to Peace Mass Transit.

The corps members were returning to their various states in the South East and South-South after their discharge from the one-year-long compulsory service. Only two of the passengers survived, though they are in critical condition at Our Savior’s Hospital where they were rushed to.

Death toll in Boko Haram attack rises to five

The death toll in Sunday's Boko Haram militants attack at a relaxation centre in Gomari, Maiduguri has risen to five.

Two unidentified victims had died on Sunday after the attack, while five others who suffered gunshot injuries were rushed to the University of Maiduguri Teaching Hospital (UMTH).

A senior officer at the hospital told the News Agency of Nigeria (NAN) that three of the injured victims died in the early hours of Monday.

He said two other victims were still lying critically ill at the emergency unit of the hospital.

The death toll in Sunday's Boko Haram militatants attack at a relaxation centre in Gomari, Maiduguri has risen to five.

Nigeria sect spreads scope with suicide bombing

LAGOS, Nigeria (AP) — Security experts in Nigeria say a radical Muslim sect is widening its scope after a suicide bombing this week at police headquarters in the capital.

Security consultant Innocent Chukwuma says Thursday's bombing, Boko Haram's first suicide attack, means the radical group is moving beyond its stronghold in the restive northeast.

The attack killed at least two people in Abuja. The group has previously struck closer to its stronghold of Maiduguri and is responsible for a string of killings in the area over the last year.

Maiduguri resident Umaru Giwi said Saturday that police are often too aggressive in seeking and killing sect members.

Boko Haram, which means "Western education is sacrilege" in the Hausa language, wants the implementation of strict Shariah law in northern states.

We’re all targets of bomb blasts, says Jonathan

President Goodluck Jonathan yesterday asked Nigerians not to panic following what was described as the first suicide bombing recorded in Nigeria, saying the ugly situation, which has become a global phenomenon, will soon be over.
The President, who was formally reacting to the twin bomb blasts that rocked the Force Headquarters, Abuja, also said the Inspector General of Police, Hafiz Ringim, was not necessarily the target as many are made to believe, explaining that everybody at the top could be a target, even the President.
President Jonathan, who looked pensive, arrived the Louis Edet House Police Headquarters at about 12.07 pm and departed at about 12.20 pm.
He was received by the IG who conducted him round the affected areas.
Jonathan, who took time to respond to questions from newsmen, commiserated with the families of the victims of the  bomb blasts.
The President said although the country is having its own share of the global phenomenon now, it would soon be over. He therefore  urged Nigerians not to panic.
"First and foremost, let me commiserate with those  people who lost their lives and property. Some vehicles were burnt and some people must have been victims of the explosion. Let me use this opportunity to assure Nigerians that it happens all over the world; no country is free.
"Nigeria has also been having some ugly incidents lately, but surely we will get over them. People should not panic at all. Soon, most of these things will become a thing of the past," he said.
On the possibility of the IG being the target of the attack, the President said no emphatically, adding: "It is not just the IG. Everybody is a target of terrorists’ attacks.
‘’I don’t want to make reference to what happened in the United States where they were to crash a plane into the White House. So, terrorists will aim at the top. If they can bomb the President, they will do it," he further said.
A few minutes after the President departed  the scene, a woman came to ascertain the fate of her husband, who she said told her he  was going to the Force Headquarters on the day of the incident.
According to the woman, she had not  heard from him since then.
With the assistance of some police officers who took her through the affected areas, the woman was able to identify her husband’s burnt car.   
At that point, she burst into tears as she ransacked the car to be sure it was her husband’s.
Her husband, whose identity could not be ascertained at press time, recently retired from the Navy.
The  woman was able to  identify some Christian pamphlets and leaflets which she said were regularly in her husband’s car.
The car, a  Mercedes Benz V-Boot, has a Lagos number plate - FE 748 AAA. From its position, it is obvious that the occupant was in the process of  parking the car at the parking lot when the bomb blasts occurred.

Former UNILAG lecturer arraigned over N8m fraud

A former lecturer at the University of Lagos, Mr Femi Olufokunbi, on Thursday appeared before an Igbosere Magistrates` Court in Lagos, charged with eight million naira fraud.

Olufokunbi (62) was arraigned on a two-count charge of stealing and obtaining money from Union Bank Plc under false pretence.

The court remanded him in police custody till June 21 when it will rule in his bail application.

The former lecturer, also a lawyer, is standing trial along with one Onyeka Dike.

The duo, however, pleaded not guilty to the charge.

The prosecutor, Insp. Zaccheus Arekhander, said that the accused and some others at large obtained the money by false pretence on behalf of some lawyers on June 1.

He said that the accused did not give the money to the lawyers and did not return it to the bank.

He said that the accused had refused persuasions from the bank to sign necessary documents to officially acknowledge the receipt of the money paid through a cheque.

Arekhander objected to the bail applications moved by the counsel to accused, Mr Gani Oyarevuegbe.

The prosecutor said that the former lecturer could interference with ongoing police investigations in the case, if granted bail.

“The money in question is still in an unfrozen account belonging to the accused; granting them bail could avail them the opportunity to withdraw it thereby jeopardising police investigations,” he said.

The defence counsel had prayed the court to grant the accused bail on self recognition.

He submitted that the former don had spent 32 years as a lawyer.

Magistrate A.A. Adefulire said: “In view of the strong objection to the bail application, the accused are hereby remanded in police custody pending ruling on the application.’’ (NAN)

Speaker bows to party in constituting House leadership

The Speaker of the House of Representatives, Aminu Waziri Tambuwal has concluded plans to select the remaining members of his leadership team along lines recommended by the ruling party, NEXT has learnt.

Sources say Mr Tambuwal and his deputy, Emeka Ihedioha, whose emergence as presiding officers ruined the zoning formula of the Peoples Democratic Party in the House, decided to make further amends by making sure the south-west and the north-east produced two of the principal officers of the House. They had earlier apologised for disobeying the zoning arrangement of the party.

In PDP's original plan for the House, the aforementioned zones were to produce the speaker and deputy speaker respectively. However, the sudden emergence of Mr Tambuwal and Mr Ehedioha from the north-west and south- east zones messed up that arrangement to the annoyance of the party.

Although the House, like the Senate, went on recess shortly after the election of Mr Tambuwal, the Speaker and his deputy together with a few members of his caucus have been busy with plans to allocate leadership positions before the resumption of sitting on June 28.

Sources close to the Speaker said he had been concerned with ensuring that agreements reached at a reconciliation meeting with the National Working Committee of the party on July 8th were implemented early enough to show good faith.

In that meeting, held at the party headquarters, Abuja, and brokered by Senate President David Mark, the party directed the new speaker to ensure that the two zones were duly compensated with leadership positions in order to balance the power sharing formula.

In plotting the selection of the remaining principal officers, therefore, sources say the Speaker and his team have made preparations to ensure that Mulikat Adeola-Akande, who was the party's candidate for Speaker, emerges the Chief Whip, while a member from the north east, Bawa Isiaka from Taraba State who had vied for the deputy speakership is to be made the new Leader of the House. Both selections, like others been made for the rest offices, are expected to be approved by the committee of the whole (House) after resumption of plenary at the end of this month.

It is not clear if the Speaker has since communicated its decision to the party or whether the choices met with the approval of the PDP hierarchy, which had insisted on being on the loop during any subsequent selection of the principal officers in the House.

Cat and mouse game

The party had earlier threatened Mr Tambuwal and his deputy with sanctions, but said all was forgiven at the last reconciliation meeting when both members made their plea. Recently, when asked if the party was still angry with him, Mr Tambuwal told reporters, "That was before, not now."

Analysts however say the party may yet pull the rug under the feet of the duo, considering the manner the Economic and Financial Crimes Commission stepped up investigations into the role of other members of the leadership of the previous assembly over contract inflation. Dimeji Bankole had, in one of his statements to the anti-graft agency, allegedly indicted Mr Tambuwal who was a member of that leadership.

Meanwhile many of the members, especially those returning, have been hanging around the Assembly to position themselves for early stake at the offices which are inadequate for the 360 members.

N40bn loan scam: Bankole, Nafada secure N200m bail

Reprieve came the way of the embattled former Speaker of the House of Representatives, Dimeji Bankole and his erstwhile deputy, Usman Bayero Nafada, as they were Wednesday released on bail by an Abuja High Court sitting at Apo.

The court specifically ordered the duo to deposit N50 million each and one surety each in like sum, stressing that the said surety must be a civil servant not below the level of a Permanent Secretary who must be resident within the Federal Capital Territory.

Justice Suleiman Belgore who released them on bail after he had dismissed a counter-affidavit that was filed by the Economic and Financial Crimes Commission, EFCC, in opposition to their consolidated bail applications, ordered the anti-graft agency to retain the diplomatic and official passports of the former Speaker and his deputy, saying they should remain in custody pending when all the conditions are perfected.

Meanwhile, the accused persons are protesting the bail terms that were handed to them by the trial High Court yesterday, saying it was too stringent.

Immediately the trial judge finished delivering his ruling yesterday, the accused persons through their counsel, Chief Michael Fashanu, SAN, pleaded for a variation of the bail condition, insisting that it may be herculean for them to get a Permanent Secretary that would be willing to stick-out his or her neck to stand surety in the matter.

Counsel to the accused persons contended that asking them to produce such caliber of civil servants would amount to technically denying his clients bail, even as he pleaded with the court to rather request for a public officer of a particular range instead of tying it to the position of a Permanent Secretary.

Following the refusal of the trial Judge to accede to the oral plea for variation, the accused persons who were subsequently whisked back to their detention cell by operatives of the anti-graft commission, said they would re-approach the court with a formal application to that effect.

The ruling was delivered on a day both the EFCC and the accused persons adduced reasons why the discretion of the High Court should sway to their favour.

Whereas the anti-graft agency urged the court to consider the weight of the charge against the former speaker and his deputy and refuse them bail, the accused persons on the other hand, pleaded the trial judge to grant them bail in self recognition, insisting that they would be available to face trial.

Nafada specifically implored the court to consider his failing heath condition and allow him to go home, maintaining that he was on Saturday June 11, involved in a fatal road accident which he said claimed seven lives.

The former speaker told the court that his present health situation warrants consistent medical attention, just as the 1st accused person, Bankole, urged the court to take cognizance of the fact that the Abuja division of the Federal High Court earlier granted him bail over a sister case that was instituted against him by the anti-graft agency.

Their submissions were vehemently opposed by EFCC lawyer, Keyamo, who insisted that the onus was on the applicants to provide material evidence that the trial court could rely upon and grant them bail.

“My lord, it is not enough for the 2nd accused person to rely on health condition to move this court to grant him bail, he has failed to produce an admissible medical report or anything that could move your lordship to show sympathetic consideration to his application.

“We also urge your lordship to discountenance his submission as it relate to the purported accident he was involved in, there is neither a police report nor anything to corroborate the story.

“Most of the depositions in their affidavit for bail did not meet legal requirements capable of moving the court to exercise its discretion to their favour.

“Averments of the 1st accused that he has two children, aged parents, about his being a former speaker, holding honours of CFR, are not legal requirements for bail. I therefore urge your lordship to refuse this bail application in its entirety”, he argued.

After listening to their arguments, Justice Belgore, yesterday, stood-down the matter till 3pm when he eventually ruled on their consolidated bail applications.

The judge relied on the provisions of section 1(1), 6 (6b), 34(4), 36(4) (5) of the 1999 constitution and section 341(2) of the Criminal Procedure Code, CPC, to release the accused person on bail pending the hearing and determination of the substantive case against them.

Though the judge waved-aside the claims of the former deputy speaker that he was suffering deteriorating health condition, he maintained that denying them bail would amount to an infringement on their constitutional rights.

The judge said he was not persuaded by the submissions of the prosecuting counsel that the accused would interfere with ongoing investigations into other allegations of corruption against them, adding that he was not convinced that they would attempt to evade trial if released on bail.

EFCC earlier told the High Court that most of the witnesses it intend to call against the duo are serving members of the National Assembly, saying there was an imminent danger that they could be influenced by the accused persons.

According to the judge, “I have carefully and meticulously read the motion papers all over and I have equally given deep consideration to the reliefs sought therein, it is my view that this application is not complex.

“The issue is whether or not the accused persons are entitled to bail and this is where section 341(2) of the CPC must come to play.

“the case of Abiola Vs FRN which was reported in 1999, 4-NWLR, stressed that an accused must place material evidence that the court will consider before exercising its discretion in granting or refusing an application for bail.

“The prosecution has argued that the 1st accused severally evaded arrest but can we say from all seriousness that he indeed evaded arrest?, the answer is found in the counter-affidavit which enumerated how many attempts that were made before he was eventually arrested on June 5.

“Failure to honour an invitation cannot be seen as evading arrest as nothing suggests that at one point in time, he was seen and he ran away.

“It is the view of this court that the EFCC was not able to locate him initially and when he was eventually located, he was accordingly arrested and taken into custody. There is nothing to show that he engaged operatives of the agency in a fight neither is there an exhibit showing that he was at any time a wanted person.

“It is not disputed that the said invitation letters were sent to the clerk of the National Assembly and not to the accused person. I cannot see the temptation for the accused persons to abscond trial in considering their antecedents.

“There is no serious risk that they will jump bail and contention of the prosecution that they will interfere with ongoing investigation is unattainable as the accused persons in their affidavit maintained that investigations into the matter were already concluded.

“This deposition was not controverted by the prosecution, it is trite law that fact not challenged are deemed to be true. I am therefore inclined to hold that investigation have been completed and whether the accused persons will interfere with further investigations is of no moment before this court.

“More so, this is the first time that the accused persons have found themselves in this mess and there is no likelihood that they may commit same is released.

“The right to bail of an accused is constitutional, I found merit in this application and accordingly grant same” the judge ruled.

Hearing on the substantive case against them was yesterday adjourned till July 19.

The accused persons, who were arraigned by the anti-graft agency on Monday, are facing trial over their alleged complicity in a N40 billion loan scam.

They had pleaded not guilty to the entire 17-count criminal charge that was preferred against them by the EFCC.

EFCC specifically alleged that they breached public trust by agreeing to approve the allowances and ‘running costs’ of members of the 6th session of House of Representatives in violation of the approved remuneration package for political, public and judicial office holders by the Revenue Mobilization Allocation and Fiscal Commission, as well as, the extant Revised Financial Regulations of the Federal Government of Nigeria, 2009, and thereby committed an offence contrary to section 97(1) of the Penal Code Act, Cap 532, Laws of the Federation of Nigeria (Abuja) 1990 and punishable under section 315 of the same Penal Code Act.

Who are Nigeria's Boko Haram Islamists?

Nigeria's militant Islamist group Boko Haram, which said it bombed the police headquarters in the capital Abuja on Thursday, is fighting to overthrow the government and create an Islamic state.

Its followers are said to be influenced by the Koranic phrase which says: "Anyone who is not governed by what Allah has revealed is among the transgressors".

Boko Haram promotes a version of Islam which makes it "haram", or forbidden, for Muslims to take part in any political or social activity associated with western society.

This includes voting in elections, wearing shirts and trousers or receiving a secular education.

Boko Haram regards the Nigerian state as being run by non-believers, even when the country had a Muslim president.


But residents in the north-eastern city of Maiduguri, where the group had its headquarters, dubbed it Boko Haram.

The group's official name is Jama'atu Ahlis Sunna Lidda'awati wal-Jihad, which in Arabic means "People Committed to the Propagation of the Prophet's Teachings and Jihad."

Loosely translated from the local Hausa language, this means Western education is forbidden.

Boko originally means fake but came to signify Western education, while haram means forbidden.

Since the Sokoto caliphate, which ruled parts of what is now northern Nigeria, Niger and southern Cameroon, fell under British control in 1903, there has been resistance among the area's Muslims to Western education.

Many Muslim families still refuse to send their children to government-run "Western schools", a problem compounded by the ruling elite which does not see education as a priority.

Audacious

Against this background, the charismatic Muslim cleric, Mohammed Yusuf, formed Boko Haram in Maiduguri in 2002. He sat up a religious complex, which included a mosque and an Islamic school.

Many poor Muslim families from across Nigeria, as well as neighbouring countries, enrolled their children at the school.

But Boko Haram was not only interested in education. Its political goal was to create an Islamic state, and the school became a recruiting ground for jihadis to fight the state.

In 2009, Boko Haram carried out a spate of attacks on police stations and other government buildings in Maiduguri.

It led to shoot-outs on Maiduguri's streets. Hundreds of Boko Haram supporters were killed and thousands of residents fled the city.

Nigeria's security forces eventually seized the group's headquarters, capturing its fighters and killing Mr Yusuf.

His body was shown on state television, and the security forces declared Boko Haram finished.

But its fighters have regrouped under a new, unidentified leader and last year it attacked a prison in Maiduguri, freeing hundreds of the group's supporters.

Its trademark has been the use of gunmen on motorbikes, killing police, politicians and anyone who criticises it, including clerics from other Muslim traditions and a Christian preacher.

In recent months, it has staged several more audacious attacks in different parts of northern Nigeria.

These reportedly include a bombing in December in the city of Jos, a New Year's eve attack on military barracks in Abuja, and several explosions around the time of President Goodluck Jonathan's inauguration last month.

Now, it has attacked the police headquarters, signalling that it is far from finished.

The threat it poses is unlikely to disappear: Poverty-stricken northern Nigeria has a history of spawning groups similar to Boko Haram.

Analysts believe the threat will disappear only if the Nigerian government manages to reduce the region's chronic poverty, and builds an education system which gains the support of local Muslims.
