Atuche’s trial : Court admits cheques, others as exhibits

LAGOS — A Lagos High Court sitting in Ikeja, weekend, admitted as exhibits, bank cheques, and other vital documents at the on-going trial of the former Managing Director of Keystone Bank (formerly Bank PHB), Mr. Francis Atuche, his wife and the former Chief Operating Officer of the bank, Ugo Anyanwu, over financial impropriety.Trial judge is Justice Lateefah Okunnu.

The documents, which included bank transfer forms, statements of account and bank drafts of some of the companies fingered in the N10.9billon loan facility were tendered by officials of Zenith International Bank Plc, Oceanic Bank Plc (now Eco bank), and FirstBank Plc, following their subpoena by Economic and Financial Crimes Commission, EFCC, counsel.

The bank officials, who tendered the subpoenaed documents were, Musediq Onasanya from Eco Bank, Sunday Ezezobor from Zenith Bank and Yusuf Abiodun Nureni from FirstBank.

The cheques, which value ran into several billions of naira were in the names of Falcon Securities Limited, Futureview Limited, Resolution Securities Limited, Falcon Securities and Petrosan Nigeria Limited, companies mentioned in N10.9 billon facility, which were used to buy BankPHB public offer in 2008.

Atuche’s counsel had challenged the admissibility of the documents from Zenith Bank, arguing that paragraph 9 of the subpoenaed document did not specify the transaction involved, which he noted was against the law of subpoena.

The trial judge admitted allthe documents, after overruling Atuche’s counsel.
