Goje Fails To Stop Trial Over N25bn Fraud
Senator Danjuma Muhammad Goje has lost his bid to stay action on his ongoing trial by the Economic and Financial Crimes Commission (EFCC) for alleged official misconduct at a Federal High Court in Gombe. Goje, a former governor of Gombe State, and four other accused persons, are being prosecuted by the EFCC in a N25billion money laundering case at the court.
In evaluating the positions of both parties, Justice Babatunde Quadri, yesterday ruled that, “No doubt, the crux of the matter relates to refusal of this court to transfer the case to Abuja or any location outside the North-East for security reasons.”
In a statement last night,the EFCC said the court reiterated the guidelines as spelt out by law for granting or otherwise of an application for stay of proceedings while maintaining that there was no special circumstance to warrant the grant of such relief.
Alluding to the prosecution’s position that Section 40 of the EFCC Act precludes the court from entertaining an application for stay of proceedings in respect of any criminal matter brought before it by the commission until judgement is delivered; Justice Quadri noted that the section denied the court the jurisdiction to entertain the application.
In his ruling, Justice Quadri held that, “This application cannot be granted as it is seemingly meant to delay proceedings in this case.”
