The prosecutor, Cpl David Udeh, told the court that on Feb 22, at about 2 a.m., Ezy Chibuzom of No 49, Arsenal Drive, Sun City, Abuja, lodged a report against the accused persons at the Wuse Zone 3 Police Station.
Udeh told the court that the accused persons stole Chibuzom’s Blackberry Q 10 and Nokia phones valued at N65,000.
He said that the accused persons were standing trial for joint act and theft, contrary to sections 79, and 287 of the Penal Code.
He said that if the accused persons were found guilty, they were liable to five years in prison, with an option of
fine or both.
Udeh urge the court to remand the accused persons in prison custody pending the investigation of the matter.
He said that the accused persons did not have a fixed address and might jump bail.
The accused persons pleaded not guilty.
The counsel to the accused, Mr Azubike Moneke, applied for their bail under section 36(5) of the 1999 Constitution which presumed an accused innocent until proven contrary.
He said that they would not jeopardise police investigation and would not jump bail.
The Senior Magistrate, Mr Aminu Eri, said: “After listening to the application of the prosecutor and the accused counsel,
the arguments of the prosecutor is not cogent enough.
“I hereby grant the accused persons bail in the sum of N100,000 with two reliable sureties in like sum who must reside within the jurisdiction of the court.’’
Eri adjourned the matter to April 2 for hearing. (NAN)
