S/Court affirms death sentence on security guard

The Supreme Court has affirmed the death sentence passed on a security guard who killed his employer, Miss. E. N. Igwe, an Assistant General Manager, Legal, working with the Power Holding Company of Nigeria.In the lead judgment delivered Friday, by Justice Suleiman Galadima, it was established that Stephen Haruna (the sppellant) was the only person in the house of the deceased at the time of her death.

On the day of the incident, 31 December 2003, the deceased was found on the floor of her house and Haruna not only confessed to her killing but also disclosed where he kept the stolen money.

There was no evidence of any forceful entry or breakage to gain entry into deceased and the accused was the only person in the compound with the deceased and nobody else.

The police recovered a number of exhibits which incriminated him. His confessional statement was corroborated by the discovery of the stolen money which he took to his girlfriend at Kubwa, a suburb of Abuja city to keep for him.

Stephen Haruna had appealed against the decision of the Court of Appeal, Abuja dated January 22, 2010 affirming the decision of the High Court of Abuja FCT dated October 6, 2008 in which he was convicted and sentenced to death for culpable homicide contrary to Section 221 of the penal code.
