JUSTICE Mohammed Yunusa of a Federal High Court sitting in Lagos, on Tuesday, struck out a suit filed by National Drug Law Enforcement Agency (NDLEA) against a drug suspect, Modupe Opeyemi, as a result of her death.
The court struck out the suit based on an application instituted by the counsel for the anti-drug agency, J.I Aernan, after informing the judge that the suspect had been sick and tested positive on retroviral screening, which also resulted in her death.
He further informed the court that the agency tried to save her life.
“We took steps to take him to Lagos University Teaching Hospital (LUTH) for medical treatment. When we could not cope with the medical cost, we took the step of releasing him to his family, whether they could undertake the treatment.
“We were later informed that he died. In the circumstance, I will hereby make an application to withdraw the charge on the strength of the medical report,” the counsel said.
After listening to the submission of the NDLEA lawyer, the judge granted the application and struck out the suit.
“The application is granted as requested. The charge is hereby struck out,” he said.
It will be recalled that Opeyemi was arrested by the NDLEA on October 18, 2012 and charged for allegedly dealing unlawfully in 8.8 kilogrammes of Cannis Sativa, a narcotic drug similar to cocaine and heroine, a strong hallucinogenic drug.
The offence, according to the prosecution, was contrary to and punishable under section 11(c) of the NDLEA Act, Cap N30 laws of the Federation of Nigeria 2004.
