Terrorism Charges: Court Clears Sanusi Lamido, Awards N50m Damages, Orders Release of Passport

Suspended Governor of the Central Bank of Nigeria, Sanusi Lamido Sanusi has won the case filed at the Federal High Court, Lagos seeking an order to retrain the police and the Department of State Security Services (DSS), from arresting him.

The court in its ruling declared that it has the jurisdiction to hear the case brought before it by the CBN boss.

Sanusi had filed the case following his arrest by the DSS few minutes after he arrived from Niger Republic, same day his suspension as the apex bank chief was announced. His passport were seized in the process.

In a counter affidavit, the DSS challenged the jurisdiction of the court and added that Sanusi is under investigation for terrorism and therefore should not get a perpetual injunction restraining the service from withholding his passport.

But in the ruling today, Justice Buba of the federal high court said the submission of the SSS of Sanusi financing terrorism lacks merit and is therefore dismissed.

He said the 3 respondents: Attorney general, IG Police and SSS are singing discordant tunes. The SSS said they are investigating him for financing terrorism but the Police is unaware of such.

The judge stated that the SSS acted with impunity and the SSS must be restrained and therefore ordered that his passport be released immediately, while a damage of N50 million is awarded to the applicant,

The 3 respondent :AG, SSS, Police have been ordered to make an apology.
