Court Sacks Delta Lawmaker



A Federal High Court in Asaba Delta State yesterday sacked a member of the State House of Assembly, Hon (Dr.) Alphonsus Ojo representing Ukwuani Constituency in suit against him by Democratic Peoples Party (DPP) and one Chukwuma Dafakpako in the suit Number FHC/ASB/CS/129/12.The plaintiffs averred that Hon Ojo wilfully dumped the party (DPP) for the Peoples Democratic Party (PDP) after winning the election to the House of Assembly adding that Section 109(g) and (8), of the Constitution of the Federal Republic as amended was violated the rules.

The defendants, Delta State government, the Speaker and Hon Alphonsus Ojo in the plaintiffs’ prayers averred that the court should grant an order of perpetual injunctions restraining the third defendant (Hon Ojo) from parading himself as the honourable member representing Ukwuani constituency.

After exhaustive legal frame works, the presiding Judge, Justice Olatoregun Isiola, held that it was an aberration on the part of the defendants who could not establish substantial authorities, especially by the third defendant (Hon Ojo) the reasons adduced that there was serious crisis at the party (DPP) and had also written to the speaker for a possible extinction of the party; a situation he could not help rather than to dump it for the Peoples Democratic party.
