Woman Banned From Ranting About Ex-Husband on Facebook
A state appellate court has ruled that a New Jersey mother's rights were not violated when a judge barred her from ranting about her children and ex-husband on Facebook.
Mycentraljersey.com reports the judge's order was a "special condition" of a probation sentence the woman received in 2011. The case stemmed from her alleged attempt to kidnap her two children and take them to Canada.
The order was imposed after her ex-husband's family and Hunterdon County prosecutors argued that the woman's Facebook postings were frightening.
The woman claimed the order violated her Constitutional right to due process because it was too vague. She also argued it violated her free speech rights.
The appellate panel disagreed, finding the order was specific and didn't prevent her from blogging about other issues.
