Lawyer slams N125m suit on airline

A Lagos-based lawyer, Mr. Ikechukwu Chiaha, has filed a suit against a Nigerian airline, Arik Air Limited, at the Federal High Court, Lagos, for alleged breach of contract through cancellation of his flight to Abuja. The lawyer is claiming N125 million as damages for the alleged default of the airline. During the proceedings before Justice Nasir Yunusa yesterday, the lawyer said the cancellation by the airline caused him to miss a legal brief worth N50 million and that he had suffered psychological trauma as a result.

He added that the client concluded that he was not serious by not honouring the appointment during which the said contract of N50 million was scheduled to be given to him.

Yunusa later adjourned the case till June 18 for further hearing.

But before the adjournment, Chiaha prayed the court to order the airline to refund him the lost N50 million, in addition to N18,000 he had paid as the cost of the air ticket.

He also wants an additional N75 million as general damages as well as interest on the total sum at 21 per cent from September 1, 2010 until judgment is delivered, as well as cost of the action.

The lawyer contended in his statement of claim that he bought an Arik Air ticket through Zenith Bank on August 31, 2010 and was issued a boarding pass, numbered ETKT 7252416610757-1.

He said he arrived at the airport as early as 5.45am and was checked in by Arik officials, and eventually took his seat aboard the plane which was scheduled to commence flight from Lagos to Abuja at 7.30am on September 1, 2010.
